General terms and conditions of sale :
1. Field of application
These General Terms and Conditions of Sale apply to all orders placed through the website: www.eurotartufi.com and for all orders received by email, mail or telephone, regardless of the clauses that may appear on the buyer’s documents.
The customer acknowledges having read the present General Terms and Conditions of Sale and accepts their terms. In the event of a case not covered by the present General Terms and Conditions of Sale, the home sales regulations of the place where the company is registered shall apply. This contract is governed by the Belgian law.
These terms and conditions of sale shall prevail over any other general or special conditions not expressly approved by the seller.
The seller reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.
2. Orders
The Palais de la Truffe agrees to accept orders placed via Internet under the terms of these General Terms and Conditions of Sale and within the limits of available stocks.
In case of stock shortage, we will inform you of the supply time needed to obtain the requested product or we will offer you a replacement product. Le Palais de la Truffe is not able to manage back orders, if a product is out of stock without a precise supply time we offer you the reimbursement of the product you have ordered.
By validating the order, the customer declares to have read and accepted these Terms and Conditions of Sale.
Any order will be taken into consideration only after reception of the payment and will be confirmed by Le Palais de la Truffe by email.
I Gialli e Rossi-Le Palais de la Truffe reserves its right to cancel all orders, non-compliant or doubtful, as well as those from a customer with whom there is any litigation in course.
3. Pricing
The indicated prices are listed in euros and are all taxes included (applicable VAT and any other applicable taxes). The prices displayed are net, they include the price of the products, the handling, packaging and storage costs of the products, and do not include the contribution to the shipping and delivery costs.
The seller reserves its right to modify its prices at any time. Nevertheless, the prices applicable to the order are those prevailing at the time of confirmation of the order.
Shipping and delivery costs vary according to the volume of products ordered and the country of expedition.
The price indicated in the order confirmation by Le Palais de la Truffe is the final price, inclusive of all taxes and Belgian VAT at 6% for food products (except wines 21%) and 21% for any other products.
4. Validity of offers
The products are to be sold within the limit of the duration of each sale and within the limit of available stocks.
I Gialli e Rossi-Le Palais de la Truffe will not be held responsible for any stock shortage that would result in a delay in the delivery of the order.
Orders are final only when they have been confirmed by the payment of the purchase price by the buyer.
In case of unavailability of one or more products after the validation of the order, I Gialli e Rossi-Le Palais de la Truffe commits to inform the customer by e-mail as soon as possible. In agreement with the customer, I Gialli e Rossi-Le Palais de la Truffe may modify the order, or will proceed to refund the unavailable product(s) by crediting the PayPal account that was used when the order was placed.
5. Delivery
I Gialli e Rossi-Le Palais de la Truffe delivers in Belgium and abroad.
The details of the delivery price is clearly mentioned in the shopping cart on the site and depends on the delivery option chosen by the customer.
The order is shipped to the delivery address chosen by the customer.
I Gialli e Rossi-Le Palais de la Truffe undertakes to make all efforts to deliver the ordered products at the earliest possible timeframe.
The average times vary depending on the delivery formula chosen by the customer.
The customer is required to carefully check his shipments upon delivery in order to immediately express any reservations to the carrier.
The information given by the buyer, when placing an order, is binding: in the event of an erroneous delivery address, the seller cannot be held responsible for the impossibility of delivering the product. In case of a mistake in the address that leads to the failure to deliver, I Gialli e Rossi-Le Palais de la Truffe will not proceed to a second delivery, the price of the order will then be refunded to the customer after reception of the returned package at I Gialli e Rossi-Le Palais de la Truffe.
6. Payment
Payment for products purchased from I Gialli e Rossi-Le Palais de la Truffe is to be made in full at the time of ordering. The products remain the property of I Gialli e Rossi-Le Palais de la Truffe until full payment is received.
We accept payment by PayPal. When processing payments, certain data will be transmitted to PayPal, including information that is mandatory for the execution of the payment, such as the total amount or billing information.

7. Customer satisfaction. I think this does not concern my internet account.
When you give us feedback on a product, your information may be transferred to YOTPO, whose servers are located in the United States. We make sure that they are adequately protected in accordance with Belgian and European regulations. The protection of our customers’ data is a priority.
8. Cancellation and return policy
In accordance with the Consumer Code, the buyer has a period of 14 days from delivery to return the product at his own risk, for reimbursement, without penalty, except for the cost of return.
The products thus returned must not have been unpacked, unsealed or used in any way.
Incomplete, damaged or soiled goods will not be taken back.
The return costs are at the customer’s expense. I Gialli e Rossi-Le Palais de la Truffe undertakes to reimburse the customer, with the exception of return postage, which remains at the customer’s expense. Reimbursement will be made within a maximum of two weeks after receipt of the return. For this means that we reimburse the full amount of the order as well as the delivery costs (outward) ? Shouldn’t we only refund the goods?
In order to use the legal cancellation period of 14 days, please fill in the cancellation request form .The goods must be returned to us the next day at the latest.

9. Ownership rights
In accordance with the provisions of the law of the 1st of May 1980, the products delivered to the customer are sold under reservation of ownership. The transfer of ownership is subject to full payment of the price of the products by the customer, at the due date agreed between the parties.
In case of non-payment of the total price of the goods at the agreed timing, I Gialli e Rossi-Le Palais de la Truffe may claim ownership of the products at the expense and risk of the customer.
10. Resellers
The offers of I Gialli e Rossi-Le Palais de la Truffe are not addressed to retailers and professionals. I Gialli e Rossi-Le Palais de la Truffe reserves its right to refuse the benefit of its offers to any customer who happens to be a professional reseller. These unilateral cancellations can take place at any time between the date of the order and during the 12 months following the date of their foreseen delivery.
11. Personal data
The creating of a customer account at I Gialli e Rossi-Le Palais de la Truffe requires from the customer the communication of a certain number of personal data concerning him/her.
These data required to process the order and to manage the commercial relations between I Gialli e Rossi-Le Palais de la Truffe and its customers are secure, kept confidential and are not subject to any commercial use by third parties.
In accordance with Law No. 78-17 of January 6, 1978 regarding informatics, data files and freedoms, the consumer has a right to access and correct any personal information concerning him
12. Warranty
I Gialli e Rossi-Le Palais de la Truffe is subject to the legal guarantee for hidden defects, as defined by article 1641 and subsequent of the Civil Code: “The seller is subject to the guarantee for hidden defects of the thing that make it unfit for the use for which it is intended, or that diminishes so much its use that the buyer would not have acquired it, or would have given a lower price, if he had known them”. Consequently, the customer has up to 2 months after the delivery date to send his complaint to I Gialli e Rossi-Le Palais de la Truffe. Beyond that period, I Gialli e Rossi-Le Palais de la Truffe will no longer be able to guarantee the products and the customer will be required to prove that the alteration of the product is prior to the receipt of the goods.

14. Legal Applicable Law
The language of this contract is French. All the clauses of the present General Terms and Conditions of Sales, all the transactions and purchase operations carried out from the www.eurotartufi.com website as well as by mail and telephone, are regulated by Belgian legislation and law. Any dispute which would not be settled amicably will be under the jurisdiction of the Tribunals of Brussels
